Welcome to GamerMart. These Terms of Service ("Terms") govern your access to and use of the GamerMart platform, available at gamermart.gg, including all related services, features, and content (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using GamerMart, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

GamerMart is a digital goods marketplace that connects buyers and sellers of gaming-related products, including but not limited to game accounts, in-game items, in-game currency, and boosting services. GamerMart acts as an intermediary platform and is not a party to the transactions between buyers and sellers. We facilitate the listing, discovery, purchase, and delivery of digital goods but do not own, control, or guarantee the items listed by sellers.

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement. GamerMart reserves the right to request proof of age and to suspend or terminate accounts that do not meet this requirement.

4. User Accounts

4.1 Registration

To use certain features of the Service, you must register for an account by providing a valid email address, username, and password. You must verify your email address before your account is fully activated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. We strongly recommend enabling two-factor authentication (2FA) using a TOTP authenticator application. You are solely responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

4.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. Providing false or misleading information may result in account suspension or termination.

5. Buyer Obligations

As a buyer on GamerMart, you agree to:

• Fund your GamerMart balance via Stripe before making purchases. All purchases are deducted from your balance.
• Review listings carefully before purchasing, including descriptions, images, and any stated conditions.
• Verify delivery of purchased goods promptly and confirm successful orders in a timely manner.
• Communicate with sellers through the platform's messaging system regarding delivery coordination.
• Refrain from initiating chargebacks through your payment provider for transactions that have been completed successfully on the platform. Chargeback abuse may result in account termination.
• Use purchased digital goods in compliance with applicable laws and the terms of the relevant game or service.

6. Seller Obligations

As a seller on GamerMart, you agree to:

• Provide accurate, honest, and complete descriptions of all listed items, including any relevant conditions, limitations, or risks.
• Deliver purchased goods promptly and exactly as described in the listing.
• Respond to buyer inquiries and delivery coordination messages in a timely manner.
• Maintain ownership and authorization to sell all listed items at the time of listing and sale.
• Comply with all applicable laws and platform policies regarding the sale of digital goods.
• Accept the outcome of dispute resolutions made by GamerMart administrators.

7. Prohibited Items and Conduct

The following are strictly prohibited on GamerMart:

• Listing or selling items obtained through fraud, theft, hacking, unauthorized access, or exploitation.
• Listing non-gaming digital goods or services unrelated to gaming.
• Creating fake or misleading listings, including the use of deceptive images or descriptions.
• Manipulating reviews, ratings, or feedback systems.
• Attempting to circumvent the platform's payment system or conducting transactions outside of GamerMart.
• Harassing, threatening, or abusing other users.
• Creating multiple accounts to evade bans, manipulate the system, or engage in fraudulent activity.
• Using the Service for money laundering, terrorist financing, or any other illegal purpose.
• Attempting to reverse-engineer, exploit, or compromise the security of the platform.

GamerMart reserves the right to remove any listing and suspend or terminate any account that violates these prohibitions, at our sole discretion.

8. Payment Terms

8.1 Balance System

GamerMart operates on a balance-based payment system. Buyers must add funds to their GamerMart balance using Stripe before making purchases. All purchases are deducted from this balance. All transactions are denominated in US Dollars (USD).

8.2 Payment Processing

Payments to fund your balance are processed by Stripe, a third-party payment processor. By adding funds, you agree to Stripe's terms of service and privacy policy. GamerMart does not store your credit card or payment details.

8.3 Fees

GamerMart may charge fees on transactions, including seller commissions or service fees. Applicable fees will be disclosed before you complete a transaction.

8.4 No Card Refunds

Funds added to your GamerMart balance are not refundable to your original payment method. Refunds for disputed or cancelled orders are issued exclusively as GamerMart balance. See our Refund Policy for full details.

9. Order Flow and Dispute Resolution

9.1 Order Process

The standard order flow is as follows: upon purchase, the order enters DELIVERY status. The seller delivers the goods, and the status updates to DELIVERED. The buyer verifies delivery and confirms, moving the order to SUCCESS. If the buyer identifies an issue, they may open a dispute.

9.2 Disputes

If a buyer believes they did not receive what was described, they may open a dispute on the order. Both parties may submit evidence. A GamerMart administrator will review the dispute and issue a resolution, which may include a refund to the buyer's balance or release of payment to the seller.

9.3 Finality

Dispute resolutions issued by GamerMart administrators are final. By using the Service, you agree to accept the outcome of any dispute resolution process.

10. Intellectual Property

10.1 Platform IP

All content, design, code, trademarks, logos, and other intellectual property associated with the GamerMart platform are owned by GamerMart or its licensors. You may not copy, modify, distribute, or create derivative works based on any part of the platform without prior written consent.

10.2 User Content

By listing items or posting content on GamerMart, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Service. You represent that you have the right to grant this license for all content you submit.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• GamerMart provides the Service on an "as is" and "as available" basis, without warranties of any kind, express or implied.
• GamerMart does not guarantee the quality, safety, legality, or authenticity of any items listed by sellers.
• GamerMart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• GamerMart's total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid to GamerMart in the twelve (12) months preceding the claim.
• GamerMart is not responsible for any loss resulting from unauthorized access to your account if you failed to maintain adequate security measures.

12. Indemnification

You agree to indemnify and hold harmless GamerMart, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

13.1 By You

You may close your account at any time by contacting [email protected]. Account closure does not entitle you to a refund of any remaining balance.

13.2 By GamerMart

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, suspected fraud, or inactivity. Upon termination, your right to use the Service ceases immediately.

13.3 Effect of Termination

Upon termination, any pending orders may be cancelled and any remaining balance may be forfeited, except where prohibited by applicable law. Provisions of these Terms that by their nature should survive termination shall remain in effect.

14. Changes to These Terms

GamerMart reserves the right to modify these Terms at any time. Material changes will be communicated through the platform or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall be resolved through the dispute resolution mechanisms described herein or, where necessary, through binding arbitration or the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
